Grand Jury clears HPD officer in May shooting

A Harris County grand jury declined on Thursday to indict a Houston police officer who shot and killed a robbery suspect in May.

The grand jury cleared officer K.R. Barnes in the May 12 shooting death of Alex Macario Rivera, 22, HPD spokeswoman Johanna Abad said.

Police chased Rivera into the Bel-Lindo Apartments in the 6200 block of West Bellfort after he was identified as a suspect in a holdup at a nearby apartment complex.

After hiding in a fenced-in patio area while police searched the complex, Rivera ran toward Barnes carrying a gun, HPD officials have said. Barnes, a nine-year veteran, ordered him at least twice to drop his weapon and then fired two times when he ran by, they said. Rivera died at the scene.

The shooting was caught on multiple surveillance cameras. The Rivera family’s attorney, Robert Luke, has said the video shows the man was unarmed and that the officer unjustly shot him in the back as he fled. Luke could not be reached for comment late Thursday.

Police have said they found a .38-caliber revolver by Rivera’s body.
